Thank you for your interest in Team Change Xperience GmbH (hereinafter referred to as the organizer). A contract between you (the customer) and the organizer is concluded upon booking. These General Terms and Conditions form an integral part of this contract. Special provisions in the agreement between the customer and Team Change Xperience GmbH take precedence over these General Terms and Conditions. We ask you to study these terms and conditions carefully.

1. Conclusion of contract/booking

A contract between the customer and the organizer is concluded upon written confirmation of the booking by the organizer. The rights and obligations of the contract become effective for the customer and the organizer from this point in time.

2. Subject matter of the contract

The organizer undertakes to provide the programs requested by the customer within the scope of its invitation to tender. Additional services can be considered after consultation with the organizer. Any additional costs shall be borne by the customer.

3. Prices

All prices are in Swiss francs, including VAT, unless otherwise stated.

4. Terms of payment

The customer pays for the service either in advance or after the organizer has provided the service. At the latest, however, 30 days after receipt of the services purchased. The organizer has the right to demand an advance payment.

5. Cancellation or contract amendment by the customer

If the client cancels definitively agreed consulting or seminar services before the start of order processing, 20% of the amount agreed in the offer will be charged as a cancellation fee. If a definitively ordered and confirmed service is canceled or postponed by the client within the last 2 weeks before the start of the event, 100% of the total costs shall be due for payment. If the cancellation is made within 4 weeks before the start of the event, 60% of the full costs will be charged. This regulation does not apply if other agreements have been made in the written offer.

6. Cancellation or contract amendments by the organizer

If a program or parts thereof cannot be carried out due to force majeure, safety concerns on the part of the organizer, official measures, strikes or unsafe weather and natural conditions, the organizer is entitled to cancel or discontinue the activities, even at short notice. Payments made will be refunded after deduction of the services and expenses already claimed. Please note that it is in everyone’s interest to ensure that the activities are carried out without risk. Decisions made by the leaders on site are final. We expressly reserve the right to make changes to the program. The organizer will endeavour to provide equivalent replacement services. The on-site workshop leaders are not authorized to accept claims from customers or third-party providers on behalf of the organizer.

7. Conditions of participation

The instructions of the organizer as well as the instructions of workshop leaders and trainers on site must be strictly followed. If instructions are disregarded or if the success of the group is at risk, the organizer reserves the right to exclude offending persons or groups from the activities. In this case, there is no entitlement to a refund. If a participant wishes to leave the workshop or activity early at their own request, the organizer will not prevent them from doing so. Good health is a prerequisite for participation in all programs. Consumption of drugs or other mind-altering substances before or during the activities is strictly prohibited. Alcohol may be served and consumed in limited and controlled quantities during the event.

8. Liability

Any liability on the part of the organizer is excluded in full. The organizer is not liable for personal injury, damage to property or financial loss.

9. Insurance

Participants are not insured by the organizer.

Depending on the program, the organizer recommends cancellation insurance. The organizer accepts no liability for accidents during the programs. Participants are responsible for taking out adequate health and accident insurance.

10. Photos and videos

Anyone taking part in an event organized by the event organizer agrees that all pictures and videos taken during the event may be published by the event organizer and used for self-promotion.

11. Cookies

We use the consent tool “CookieYes” to manage the cookies and similar technologies used (tracking pixels, web beacons, etc.) and related consents.

The legal basis for the processing of personal data in this context is the Data Protection Act. Our legitimate interest is the management of the cookies and similar technologies used and the related consents.

The provision of personal data is neither contractually required nor necessary for the conclusion of a contract. You are not obliged to provide the personal data. If you do not provide the personal data, we will not be able to manage your consents.

12. Applicable law, place of jurisdiction

The legal relationship between the customer and the organizer shall be governed exclusively by Swiss law. The exclusive place of jurisdiction for legal action against the organizer shall be Schwyz. More stringent provisions of the General Terms and Conditions of Contract shall take precedence over the relevant statutory provisions.
